General Terms and Conditions Spaendonck Sport

This is a translation of the Dutch general terms and conditions. In the event of any discrepancy, the Dutch version prevails.

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

1. Consumer: the natural person who is not acting for purposes related to their trade, business, craft or profession.
2. Entrepreneur: Spaendonck Sport, established in 's-Hertogenbosch, which offers products and services at a distance.
3. Distance contract: a contract concluded using one or more techniques for distance communication.
4. Right of withdrawal: the consumer's right to dissolve the contract within the cooling-off period of 30 days.
5. Cooling-off period: the period within which the consumer can exercise their right of withdrawal.
6. Products: all goods offered by Spaendonck Sport, such as golf items, accessories and related products.

Article 3 – Membership of Stichting Webshop Keurmerk

1. SpaendonckSport.com is a member of Stichting Webshop Keurmerk, which means that we meet the requirements and conditions of this quality mark.
2. Where these general terms and conditions deviate from the conditions of Stichting Webshop Keurmerk, the conditions of Stichting Webshop Keurmerk apply, unless agreed otherwise.
3. More information about the quality mark and its conditions can be found on the website of Stichting Webshop Keurmerk (www.keurmerk.info).

Article 4 – Applicability

1. These general terms and conditions apply to all offers, contracts and deliveries of Spaendonck Sport.
2. The terms and conditions are made available to the consumer before or at the time the contract is concluded.
3. Deviations from these terms and conditions are only valid if agreed in writing by both parties.

Article 5 – The offer

1. The offer contains a complete and accurate description of the products offered. Obvious errors or mistakes in the offer do not bind Spaendonck Sport.
2. All prices include VAT, and any additional costs are clearly stated.

Article 6 – The contract

1. The contract is concluded at the moment the consumer accepts the offer and Spaendonck Sport confirms it.
2. For electronic contracts, receipt of the order is confirmed immediately.

Article 7 – Right of withdrawal

1. Consumers have the right to withdraw from the contract within 30 days without giving any reason.
2. The withdrawal period starts on the day the consumer receives the product.
3. To exercise the right of withdrawal, the consumer can contact us via info@SpaendonckSport.com.

Article 8 – Exclusion of the right of withdrawal

The right of withdrawal does not apply to:

1. Products that have been specially personalised for the consumer.
2. Products that cannot be returned for hygiene reasons once the seal has been broken.

Article 9 – Delivery

1. Spaendonck Sport aims for a delivery time of 1–5 working days, unless agreed otherwise.
2. Delivery takes place at the address provided by the consumer.
3. In the event of a delay, the consumer will be informed in good time and has the right to dissolve the contract.

Article 10 – Payment

1. Payment must be made using the payment methods indicated on the website.
2. In the event of late payment, Spaendonck Sport reserves the right to cancel the order.

Article 11 – Warranty and conformity

1. Spaendonck Sport guarantees that the products comply with the contract, the specifications in the offer and legal requirements.
2. Defects or faults must be reported within a reasonable period after discovery.

Article 12 – Complaints procedure

1. Complaints about the performance of the contract must be described fully and clearly and submitted within 7 days of discovery via info@SpaendonckSport.com.
2. Complaints are handled within 14 days. If this is not possible, the consumer receives an indication of the processing time.

Article 13 – Disputes

1. Contracts between Spaendonck Sport and the consumer are governed exclusively by Dutch law.
2. Disputes may be submitted to the competent court in 's-Hertogenbosch.
3. Disputes may also be submitted to the independent disputes committee of Stichting Webshop Keurmerk, in accordance with the conditions of the quality mark.

Article 14 – Privacy and data processing

Spaendonck Sport processes personal data in accordance with the General Data Protection Regulation (GDPR). See our Privacy statement for more information.

Article 15 – Final provisions

1. Any additional or deviating provisions may not be to the detriment of the consumer.
2. Spaendonck Sport reserves the right to amend the general terms and conditions. Changes will be communicated to the consumer in good time.
