Article 1 – Definitions

In these terms and conditions the following terms shall have the following meanings:

1. Consumer : The natural person who is not acting for purposes relating to his trade, business, craft or profession.
2. Entrepreneur : Spaendonck Sport, established in 's-Hertogenbosch, which offers products and services remotely.
3. Distance contract : A contract whereby use is made of one or more techniques for distance communication.
4. Right of withdrawal : The consumer's right to cancel the agreement within the cooling-off period of 30 days.
5. Cooling-off period : The period within which the consumer can make use of his right of withdrawal.
6. Products : All goods offered by Spaendonck Sport, such as golf articles, accessories, and related products.

Article 3 – Affiliation with the Webshop Quality Mark Foundation

1. SpaendonckSport.nl is affiliated with the Webshop Quality Mark Foundation , which means that we meet the requirements and conditions of this quality mark.
2. In cases where these general terms and conditions deviate from the terms and conditions of the Webshop Quality Mark Foundation, the terms and conditions of the Webshop Quality Mark Foundation shall apply, unless otherwise agreed.
3. More information about the quality mark and the conditions can be found on the website of the Webshop Quality Mark Foundation ( www .keurmerk .info ).

Article 4 – Applicability

1. These general terms and conditions apply to all offers, agreements and deliveries of Spaendonck Sport.
2. The terms and conditions will be made available to the consumer before or during the conclusion of the agreement.
3. Deviations from these conditions are only valid if agreed in writing by both parties.

Article 5 – The offer

1. The offer contains a complete and accurate description of the products offered. Obvious errors or mistakes in the offer do not bind Spaendonck Sport.
2. All prices include VAT and any additional costs are clearly stated.

Article 6 – The agreement

1. The agreement is concluded at the time of acceptance of the offer by the consumer and confirmation thereof by Spaendonck Sport.
2. In case of electronic agreements, receipt of the order is confirmed immediately.

Article 7 – Right of withdrawal

1. Consumers have the right to cancel the agreement within 30 days without giving any reason.
2. The withdrawal period commences on the day the consumer receives the product.
3. To exercise the right of withdrawal, the consumer can contact us via info @SpaendonckSport .nl .

Article 8 – Exclusion of the right of withdrawal

The right of withdrawal is excluded for:

1. Products that are personalized especially for the consumer.
2. Products that cannot be returned for hygienic reasons if the seal has been broken.

Article 9 – Delivery

1. Spaendonck Sport strives for a delivery time of 1-5 working days, unless otherwise agreed.
2. Delivery will take place at the address specified by the consumer.
3. In the event of a delay, the consumer will be informed in a timely manner and will have the right to terminate the agreement.

Article 10 – Payment

1. Payment must be made via the payment methods indicated on the website.
2. In case of late payment, Spaendonck Sport reserves the right to cancel the order.

Article 11 – Warranty and conformity

1. Spaendonck Sport guarantees that the products comply with the agreement, the specifications in the offer and legal requirements.
2. Defects or errors must be reported within a reasonable time after discovery.

Article 12 – Complaints procedure

1. Complaints about the performance of the agreement must be fully and clearly described and submitted within 7 days of discovery via info @SpaendonckSport .nl .
2. Complaints will be processed within 14 days. If this is not possible, the consumer will receive an indication of the processing time.

Article 13 – Disputes

1. Agreements between Spaendonck Sport and the consumer are exclusively governed by Dutch law.
2. Disputes can be submitted to the competent court in 's-Hertogenbosch.
3. Disputes can also be submitted to the independent disputes committee of the Webshop Keurmerk Foundation, in accordance with the conditions of the quality mark.

Article 14 – Privacy and data processing

Spaendonck Sport processes personal data in accordance with the General Data Protection Regulation (GDPR). See our Privacy Statement for more information.

Article 15 – Final provisions

1. Any additional or deviating provisions may not be to the detriment of the consumer.
2. Spaendonck Sport reserves the right to change the general terms and conditions. Changes will be communicated to the consumer in a timely manner.
